VTUBOX Terms of Service
1. Acceptance of Terms
By accessing, using, or registering for VTUBOX services, you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
These terms constitute a legally binding agreement between you and VTUBOX. Your continued use of our services constitutes acceptance of any modifications to these terms.
2. Description of Service
VTUBOX is a digital financial services platform that provides:
- VTU Services: Airtime purchase, data bundle purchase, TV subscription payments
- Utility Payments: Electricity bill payments, water bill payments
- Digital Wallet: Secure wallet for storing and managing funds
- Payment Processing: Secure payment processing through licensed payment providers
- Referral Program: Commission-based referral system for users
Our services are provided through partnerships with licensed service providers and payment processors in Nigeria.
3. Eligibility and Registration
To use our services, you must:
- Be at least 18 years old and have legal capacity to enter into contracts
- Be a resident of Nigeria or have a valid Nigerian phone number
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Complete KYC (Know Your Customer) verification as required by law
- Not be prohibited from using our services under applicable law
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Wallet and Payment Terms
Wallet Funding: You can fund your wallet through various payment methods including bank transfers, debit cards, and other approved payment channels. All payments are processed securely through licensed payment providers.
Wallet Usage: Funds in your wallet are held in trust and can only be used for approved services on our platform. You cannot transfer funds to other users or withdraw funds to external accounts without completing required verification.
Transaction Limits: We may impose transaction limits based on your account verification level, regulatory requirements, and risk assessment.
5. Service Availability and Limitations
While we strive to maintain high service availability, we do not guarantee uninterrupted access to our services. Service availability may be affected by:
- Technical maintenance and system updates
- Third-party service provider outages
- Regulatory restrictions or compliance requirements
- Force majeure events beyond our control
- Network connectivity issues
Service Modifications: We reserve the right to modify, suspend, or discontinue any service with reasonable notice to users.
6. User Responsibilities and Prohibited Activities
You agree to:
- Use our services only for lawful purposes and in compliance with Nigerian laws
- Provide accurate information and update it promptly when it changes
- Maintain the security of your account credentials
- Report any unauthorized use of your account immediately
- Not engage in fraudulent, illegal, or unauthorized activities
- Not attempt to circumvent security measures or system limitations
- Not use our services for money laundering or terrorist financing
- Not create multiple accounts to circumvent restrictions
- Not interfere with the proper functioning of our services
Prohibited Activities include: Money laundering, fraud, identity theft, unauthorized access, system manipulation, and any activity that violates applicable laws or regulations.
7. Fees and Charges
Service Fees: We may charge fees for certain services. All fees are clearly displayed before you complete a transaction. Fees may include:
- Transaction processing fees
- Wallet funding fees
- Service provider charges
- Regulatory compliance fees
Fee Changes: We may modify fees with reasonable notice. Continued use of our services after fee changes constitutes acceptance of the new fees.
8. Referral Program Terms
Referral Eligibility: You may earn commissions by referring new users to our platform, subject to the following terms:
- Referrals must be genuine and not created through fraudulent means
- Referred users must complete registration and verification
- Commission rates are determined by us and may change with notice
- Commissions are paid only for qualifying transactions
- We reserve the right to modify or terminate the referral program
Commission Payment: Commissions are credited to your wallet and are subject to the same terms as other wallet funds.
9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
KYC Compliance: We are required by law to collect and verify certain information about our users. This includes identity verification, address confirmation, and other information required by regulatory authorities.
10. Intellectual Property Rights
Our Rights: All content, trademarks, logos, and intellectual property on our platform are owned by VTUBOX or our licensors. You may not use, copy, modify, or distribute our intellectual property without permission.
Your Content: You retain ownership of any content you provide to us, but grant us a license to use it for providing our services and complying with legal obligations.
11. Limitation of Liability and Disclaimers
Service Disclaimer: Our services are provided "as is" without warranties of any kind. We do not guarantee that our services will be uninterrupted, error-free, or completely secure.
Liability Limitation: To the maximum extent permitted by law, VTUBOX shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages resulting from third-party service provider failures
- Damages resulting from user negligence or misuse
- Damages resulting from force majeure events
Maximum Liability: Our total liability to you for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Account Suspension and Termination
We may suspend or terminate your account if:
- You violate these terms or applicable laws
- You engage in fraudulent or suspicious activities
- You provide false or misleading information
- We are required to do so by law or regulatory authorities
- You fail to complete required verification processes
Account Closure: You may close your account at any time by contacting our support team. Upon closure, any remaining funds will be returned to you after verification, subject to applicable fees.
13. Dispute Resolution
Informal Resolution: We encourage you to contact us first to resolve any disputes informally. Most issues can be resolved through our customer support team.
Mediation: If informal resolution fails, disputes may be referred to mediation through a mutually agreed mediator.
Arbitration: Any disputes not resolved through mediation shall be resolved through binding arbitration in accordance with Nigerian arbitration laws.
Governing Law: These terms are governed by Nigerian law, and any disputes shall be subject to the jurisdiction of Nigerian courts.
14. Regulatory Compliance
Licensing: We operate under applicable Nigerian financial services regulations and maintain necessary licenses and permits.
AML/CFT: We comply with Anti-Money Laundering (AML) and Counter-Terrorism Financing (CFT) regulations. We may request additional information or documentation to comply with these requirements.
Reporting: We may be required to report certain transactions to regulatory authorities as required by law.
15. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes through:
- Email notifications to registered users
- Prominent notices on our platform
- In-app notifications
Acceptance: Continued use of our services after changes constitutes acceptance of the new terms. If you do not agree with the changes, you must stop using our services and may close your account.
